Our Business Liability
1. No Liability for Power Surges
The RV Park ("Owner") shall not be held liable for any damage to Tenant's RV, personal property, or equipment resulting from power surges, electrical fluctuations, outages, or any other electrical-related issues. Tenant understands and agrees that electrical service is provided as a convenience and is subject to interruptions beyond the control of the Owner.2. Tenant Responsibility for Protection
Tenant acknowledges that it is their sole responsibility to use a proper, functioning surge protector to safeguard their RV and electrical equipment from potential power surges or fluctuations. Failure to use a surge protector shall constitute an assumption of risk by the Tenant, and the Owner shall not be responsible for any resulting damages.3. Limitation of Liability
Owner shall not be responsible for damages caused by power surges or outages, whether resulting from acts of nature, accidents, utility company failures, maintenance work, or any other unforeseen events. In the event that damage occurs due to electrical issues caused by the Owner's direct negligence, liability shall be limited only to the repair of the affected electrical service and shall not extend to damages suffered by the Tenant.4. Indemnification
Tenant agrees to indemnify, defend, and hold harmless the Owner, its employees, and agents from any claims, losses, damages, or expenses, including attorney’s fees, arising out of or related to power surge-related damages unless caused by willful misconduct or gross negligence of the Owner.
